01Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of the Garaji mobile application, the website at garajiae.com, the Makanik AI assistant, and all related services (together, the "Service"), provided by [Garaji Legal Entity Name] (trade licence no. [INSERT]), a company registered in [Emirate], United Arab Emirates ("Garaji", "we", "us", or "our").

By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

02Eligibility

You must be at least 18 years old and capable of forming a binding contract under UAE law to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete.

03Definitions

"Makanik" means the AI assistant within the Service. "Content" means any text, images, data, or other material made available through the Service. "User Content" means Content you submit, including community posts and inputs to Makanik. "Garage" means an independent third-party service provider listed or matched through the Service. "Seller" means an independent third-party parts seller. "Credits" means prepaid credit packs that may be purchased to access certain paid features.

04The Service

The Service provides AI-assisted tools for vehicle owners in the UAE, which may include AI diagnostics, accident guidance, matching with and booking of third-party garages, a parts marketplace connecting you with third-party sellers, and a community where users share advice and content. We may add, change, suspend, or remove features at any time.

05Your account

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.

06AI outputs — important disclaimer

Informational only. Makanik's diagnoses, severity ratings, cost estimates, parts suggestions, and guidance are generated by automated systems for general information only. They are estimates, not a professional inspection, and not a guarantee of any condition, cost, or outcome.

Not a substitute for professional judgement. AI outputs do not replace assessment or service by a qualified mechanic or other professional. Always have your vehicle inspected by a qualified professional before relying on any diagnosis or making repair or safety decisions.

Emergencies and accidents. The Service does not provide emergency services. In an accident or emergency, contact the police, ambulance, and other relevant authorities directly. Accident guidance within the Service is general information only and does not replace the instructions of the authorities, your insurer, or qualified advisers.

No liability for reliance. To the maximum extent permitted by law, Garaji is not responsible for any loss or damage arising from your reliance on AI outputs. You are solely responsible for decisions you make based on the Service.

07Use of your interactions to improve the Service

You acknowledge and agree that, as described in our Privacy Policy, your interactions with the Service — including the symptoms, questions, vehicle information, content, and feedback you provide — may be collected, stored, and used in de-identified or aggregated form to operate, evaluate, train, and improve our AI models and the Service. Where required, this use is subject to your consent and the controls described in the Privacy Policy.

08Acceptable use

You agree not to: use the Service for any unlawful, fraudulent, or harmful purpose; misuse, disrupt, overload, or attempt to gain unauthorised access to the Service or its systems; reverse-engineer, scrape, or copy the Service except as permitted by law; submit false, misleading, infringing, or harmful Content; impersonate others or misrepresent your affiliation; use the Service to build or train a competing product or model; or use the Service in any way that violates UAE law, including the UAE Cybercrime Law (Federal Decree-Law No. 34 of 2021).

09Community and user content

You are responsible for your User Content and must hold the rights necessary to share it. User Content must not be unlawful, defamatory, obscene, infringing, hateful, threatening, or otherwise objectionable.

By submitting User Content, you grant Garaji a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display, adapt, and distribute that Content for operating, providing, and promoting the Service, and to moderate it.

We may, but are not obliged to, review, moderate, remove, or restrict User Content (including by automated means) that we reasonably believe violates these Terms or applicable law. We are not responsible for User Content posted by others.

10Garages, sellers, and bookings

Garaji is a facilitator. The Service connects you with independent Garages and Sellers. Garaji is not a party to any contract for repair, service, or sale between you and a Garage or Seller, does not perform vehicle services, and does not sell parts itself.

No endorsement or guarantee. While we take reasonable steps regarding the parties on our platform, we do not guarantee the quality, pricing, timeliness, safety, or outcome of any service or product. Any dispute regarding a service or product is between you and that third party.

Bookings. When you make a booking, we may share your details with the relevant Garage and provide a booking reference. You are responsible for attending bookings and for your dealings with the Garage.

11Payments, credits, and pricing

Core features of the Service are provided free of charge. Certain features may require the purchase of Credits or other paid options, the price of which will be shown before purchase.

Credits are prepaid and may be used to access designated paid features. Unless stated otherwise at purchase or required by law, Credits are non-transferable, and any expiry or non-expiry terms will be those shown at the time of purchase.

Payments are processed by third-party payment providers (for example, [INSERT]); you agree to their terms in addition to ours. Prices may be exclusive or inclusive of VAT as indicated at checkout, and you are responsible for any applicable taxes not collected by us.

Refunds, where offered, are governed by the terms shown at purchase and by your statutory rights under the UAE Consumer Protection Law (Federal Decree-Law No. 15 of 2020) and its Executive Regulations. Nothing in these Terms limits any non-waivable consumer rights you have under UAE law.

12Intellectual property

The Service, including all software, the Makanik assistant, designs, text, graphics, logos, and trade marks (including "Garaji" and "Makanik"), excluding User Content and third-party content, is owned by or licensed to Garaji and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes in accordance with these Terms. No other rights are granted.

13Third-party services

The Service may integrate with or link to third-party services. Your use of those services is governed by their own terms and privacy policies, and Garaji is not responsible for them.

14Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI outputs will be accurate or complete. Nothing in this section excludes any warranty or right that cannot be excluded under UAE law.

15Limitation of liability

To the maximum extent permitted by applicable law, Garaji and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Service. Garaji's total aggregate liability will not exceed the greater of the total amounts you paid to Garaji in the [twelve (12)] months preceding the event giving rise to the claim, or [AED 500]. Nothing here excludes or limits liability that cannot be excluded under UAE law.

16Indemnification

You agree to indemnify and hold harmless Garaji and its officers, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, your dealings with Garages or Sellers, or your breach of these Terms or applicable law.

17Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service or its users. Provisions that by their nature should survive termination (including the AI disclaimer, IP, disclaimers, limitation of liability, indemnity, and governing-law sections) will survive.

18Governing law and dispute resolution

These Terms are governed by the laws of the United Arab Emirates as applied in the [Emirate of Dubai]. Subject to any non-waivable rights you have, you and Garaji agree to submit to the exclusive jurisdiction of the courts of [the Emirate of Dubai — CONFIRM]. Before commencing proceedings, the parties will attempt in good faith to resolve any dispute amicably.

19Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a revised date and, where the changes are material, provide additional notice through the Service. Your continued use after the changes take effect constitutes acceptance of the updated Terms.

20General

Force majeure: we are not liable for any failure or delay caused by events beyond our reasonable control. Severability: if any provision is held invalid, the remaining provisions remain in force. Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and Garaji regarding the Service. Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Waiver: our failure to enforce any provision is not a waiver of it.
